HOW TO ENTER

To enter, individuals must complete the following steps during the Promotion Period:

a) purchase at least one (1) or more education Experience product/s using the order form (found in the Education Experience Toys and More Fundraising Catalogue or online at www.toysandmore.com.au);

    and

b) leave the Opt Out box unchecked on the order form.

The Education Experience Toys and More Fundraising Catalogue will be distributed to selected child care centres, kindergartens and primary schools, to hand out to parents/guardians. The completed manual order forms must be returned to the individual childcare centre, kindergarten or primary school where they collected their Education Experience Toys and More Fundraising Catalogue during the Promotion Period.

For the sake of clarity, individuals who select the 'Opt Out' box on the order form will not be entered into the promotion.

CONDITIONS OF ENTRY

  1. Information on how to enter and the prize/entitlement form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.
  2. Entry is only open to Australian residents who are:
      a) aged 18 years or over; and
      b) are the parent/legal guardian of a child aged under 10 years, as at the date of the draw.
  3. Employees (and their immediate families) of the Australian Scholarships Group Friendly Society Limited, its affiliates and their agencies associated with this promotion are ineligible to enter.
  4. Limit one (1) entry permitted per household and per Education Experience product purchased in accordance with the entry requirements.
  5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants as required by law (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  6. Incomplete, indecipherable or illegible entries will be deemed invalid.
  7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  8. Promotion commences on 01/07/11 and entries close at 5:00pm AEST on 30/06/12 ("Promotion Period"). The draw will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne, Victoria, 3004 on 11/07/12 at 3pm AEST.
  9. Winner will be notified by phone within 2 days of the draw. A notification will also be sent by mail. The winner's name will be published in The Australian on 25/07/12.
  10. The Promoter's decision in relation to all aspects of this promotion is final and no correspondence will be entered into.
  11. The first valid entry drawn will win an ASG Education Scholarship for one (1) child to whom they are a legal guardian/parent of (child must be aged between 0 and 10 years of age at the draw date). The nominated child will be enrolled into The Education Fund (TEF) Plan A program ("ASG Education Scholarship"). The projected total value of the Education Scholarship is up to $15,171 based on child's age at enrolment, ASG projected earnings and level of study undertaken. Maturity and payment details of the Education Scholarship are subject to the standard terms and conditions contained in 'ASG's Education Program' Combined Financial Services Guide and Product Disclosure Statement, which is available from the Society's Registered Office or any ASG Information Centre.
  12. If for any reason the winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited. A draw for the prize, if unclaimed, will then take place on 15/10/12 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified by phone within 2 days of the draw and by mail and their name will be published in The Australian on 18/10/12.
  13. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  14. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as a cash lump sum.
  15. Entrants consent to the Promoter using their name, likeness, voice and/or image in the event they are a winner (including photograph, and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify/suspend/ terminate/cancel the promotion, as appropriate.
  17. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  18. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value that stated in these Conditions of Entry; (e) any tax liability incurred by the winner or entrant; or (f) acceptance/use of the prize.
  19. As a condition of accepting the prize, the winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  20. The Promoter collects entrant's personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties associated with the Promoter, and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
